These Terms of Service ("Terms") govern your use of NomNom POS, a Point of Sale (POS) application provided by NomNom Services LTD ("we," "us," or "our"). By accessing or using NomNom POS, you ("User," "you," or "your") agree to comply with these Terms. If you do not agree, you may not use the application.
By registering for or using NomNom POS, you confirm that:
You are at least 18 years old or have legal authority to bind a business.
You agree to these Terms and our Privacy Policy.
You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
Notify us immediately at support@nomnom.co.ke if you suspect unauthorized access.
We grant you a limited, non-exclusive, non-transferable license to use NomNom POS for lawful business purposes.
You agree not to:
Reverse-engineer, modify, or distribute the software.
Use NomNom POS for illegal or fraudulent transactions.
Share accounts or access with unauthorized users.
Disrupt the app’s functionality or security.
Subscription fees (if applicable) are billed monthly/annually and are non-refundable unless required by law.
You must provide valid payment details and authorize automatic billing.
We reserve the right to modify pricing with 30 days’ notice.
You retain ownership of your business data (e.g., sales, customer transactions).
We process data per our Privacy Policy (GDPR-compliant).
By using NomNom POS, you consent to data storage on AWS servers (US/EU).
We may suspend or terminate your account for violations of these Terms.
You may cancel your subscription at any time, but no refunds will be issued.
Upon termination, you must cease all use of NomNom POS.
NomNom POS is provided "as-is" without warranties of merchantability or fitness for a particular purpose.
We are not liable for:
Financial losses due to app downtime.
Data breaches caused by user negligence.
Third-party integrations (e.g., payment processors).
Our total liability is limited to fees paid in the last 6 months.
You agree to indemnify us against claims arising from:
Your misuse of NomNom POS.
Violation of laws or third-party rights.
These Terms are governed by Kenyan law.
Disputes will be resolved through negotiation, then courts in Nairobi, Kenya.
We may update these Terms and will notify users via email or in-app alerts. Continued use constitutes acceptance.
